These terms govern your use of vigilocity.com (the “Site”), operated by Vigilocity, LLC (“Vigilocity”, “we”, “us”). By accessing the Site you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Site.

The Site is informational. The Mythic platform, our data feeds, our API, and our other products and services are provided under separate written agreements between Vigilocity and its customers, and nothing on the Site forms part of those agreements or constitutes an offer to provide services on any particular terms.

Use of the Site

You may use the Site only for lawful purposes. You agree not to interfere with the operation or security of the Site; probe, scan, or test it except as described in our responsible disclosure policy; scrape or harvest content or data from it at scale; misrepresent your identity or affiliation; or use the Site to transmit anything unlawful or harmful. We may suspend or terminate access to the Site at any time.

Content

Content on the Site is provided for general information. It is not legal, financial, insurance, or security advice, and it is not a substitute for professional judgment applied to your circumstances. Descriptions of our products, methods, and results are summaries; the capabilities delivered to any customer are defined by that customer’s agreement. We work to keep the Site accurate but do not warrant that any content is complete, current, or error-free.

Intellectual property

The Site and its contents, including text, graphics, design, datasheets, and software, are owned by Vigilocity or its licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive license to view the Site and to download materials we make available for download, such as datasheets, for your internal business evaluation. Any other reproduction, distribution, or commercial use requires our prior written permission.

Vigilocity and Mythic are trademarks of Vigilocity, LLC. Third-party names and marks referenced on the Site, including MITRE ATT&CK and NIST, belong to their respective owners, and their appearance does not imply affiliation or endorsement.

Third-party sites and services

The Site links to third-party sites and services, including our API documentation and social media profiles. We are not responsible for their content or practices, and linking does not imply endorsement.

Disclaimers

The Site is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or free of errors or harmful components.

Limitation of liability

To the maximum extent permitted by law, Vigilocity and its officers, employees, and agents will not be liable for any indirect, incidental, special, punitive, or consequential damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Site, even if advised of the possibility of such damages. To the extent any liability cannot be excluded, our total liability arising from your use of the Site will not exceed one hundred US dollars.

Indemnification

You agree to defend, indemnify, and hold harmless Vigilocity, its affiliates, and their officers, employees, and agents from claims, damages, and expenses, including reasonable attorneys’ fees, arising from your use of the Site in violation of these terms or of any law or third-party right.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute arising from these terms or your use of the Site will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

General

If any provision of these terms is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver of it. These terms are the entire agreement between you and Vigilocity regarding use of the Site.

Changes to these terms

We may revise these terms by updating this page. The date at the top reflects the latest revision, and your continued use of the Site after changes take effect constitutes acceptance of the revised terms.
